Messaging Compliance Addendum

Company Name: Drip Club ("Company," "we," "our," or "us")

This Messaging Compliance Addendum ("Addendum") supplements and forms part of our Terms of Service. By using our platform, you agree to the following:

1. Compliance Obligations

  • You are solely responsible for ensuring that all messages you send comply with applicable laws and regulations, including but not limited to:
    • Telephone Consumer Protection Act (TCPA)
    • Cellular Telecommunications Industry Association (CTIA) guidelines
    • CAN-SPAM Act
    • Carrier and TCR/10DLC requirements
  • You must obtain and maintain valid, documented opt-in consent from all recipients before sending any message.
  • You must honor all opt-out ("STOP") and support ("HELP") requests immediately.

2. Liability & Indemnification

  • You acknowledge that the Company provides a messaging platform only and does not create, review, or approve your message content.
  • You accept full responsibility and liability for all traffic sent from your account.
  • If fines, penalties, legal claims, or damages arise from your use of the service, you agree to indemnify, defend, and hold harmless the Company, its officers, employees, and affiliates.

3. Campaign Registry & Carrier Rules

  • You must provide truthful and accurate information when registering brands and campaigns with The Campaign Registry (TCR).
  • You are responsible for ensuring that your campaigns remain approved and compliant at all times.

4. Enforcement

  • The Company may suspend, block, or terminate your account without refund if you violate this Addendum.
  • Carriers and regulators may impose fines or block traffic; you agree that any such consequences are your responsibility alone.

5. Acknowledgment

By using our platform, you confirm that you:

  • Understand and accept your sole responsibility for compliance.
  • Agree that the Company is not liable for your messaging practices.
  • Will comply with all applicable rules, regulations, and guidelines.
